Is rent to rent legal?

Yes, but only if specific conditions are met, primarily that the landlord gives explicit written consent to sublet. If done without permission, it can be illegal, breach mortgage terms, and violate insurance policies.

 

Why would a landlord agree to this?

Landlords often agree to this to secure a "guaranteed rent" for a long term (e.g., 3-5 years) with no void periods as this offers no management hassle, and sometimes with the operator covering maintenance costs covered.  some landlords also agree rent to rent for short periods while their property is waiting to be sold or they are away from the property for an extended period of time.

 

What are the common types of rent to rent?

  • Rent-to-HMO: Renting a family home and renting it out room-by-room.
  • Rent-to-SA (Serviced Accommodation): Renting a property to list on platforms like Airbnb.

 

What contracts should I use?

You should not use a standard AST (Assured Shorthold Tenancy). You need a specialised commercial let agreement, such as a Management Agreement or a Company Let Agreement with a subletting clause

Will my mortgage allow this?
